On September 26,1996, Northeast Nuclear Energy Company (NNECO) informed the NRC,-

pursuant to Title 10 of the Code of Federal Ra9ulations. Section 50.72(b)(iii)(D), that it had

. identified 21 safety-related air operated valves that are controlled by solenoid operated pilot -

valves, which do not receive Class 1E power. NNECO followed up the event notification with q LER 96-036-00, dated October 25,1996. . By letter dated February 12,1997, the NRC requested '

i additional information regarding the subject LER, which NNECO iesponded to on April 18,1997. '

The NRC staff has completed a preliminary review of the event and has conducted additional onsite review of NNECO's corrective actions. Based on these reviews, the staff has identified -

severalissues that require additionalinformation. Please respond to the enclosed request for '

Ul1Tl IITLE 10 OF THE CODE OF FEDERAL REGULATCNS DOCKET NO. 50-423 TAC M98860 On September 26,1996, Northeast Nuclear Energy Company (NNECO) informed the NRC, pursucnt to Section 50.72(b)(2)(iii)(D), that it had idt.n.ied 21 safety-related air operated valves (AOVs) that are controlled by solenoid operated pilot valves (SOVs), which do not receive Class 1E power. The 21 SOV/AOV control switches, whose failure could affect safety system capability, were not included in the Millstone Unit 3 quality assurance program. During subsequent revisions to Licensee Event Report (LER) 96-036-00 and onsite review of NNECO's corrective actions following the submittal of the LER, it is the understanding of the NRC staff that the NNECO review has identified approximately 114 valves that are affected.

i Following an internal review, NNECO identified that for 62 of the valves, engineering analysis has determined that the position of the valves is of no consequence during design basis events, in additio,i, NNECO identified 4 valves that have an active safety

' metion imd it is the NRC's understanding that these valves will be upgraded to safety-related status prior to Mode 4. For the above mentioned 66 valves, confirm that the NRC's understanding of the valves disposition is correct.

For 32 of the remaining 48 valves, it is the NRC's understending that the valves are in the fail safe position and must remain in the fail safe de-energized position during design basis events to support proper operatior of the associated safety-related system. These valves are also exposed to harsh environmental conditions during design basis events.

a. It is the NRC's understanding that these 32 valves are being modified to eliminate the potential failures associated with exposure to harsh environmental condithns.

Please confirm that the NRC's understanding !s correct.

b. For the 32 valves, list the valves (and the system they are in) which are in redundant trains and which valves are in nonredundant trains.
c. For the valves in redundant trains, describe why a single random failure of a raceway (or failure of one of the circuits routed in the raceway) containing redundant nonsafety control circuits (in conjunction with a design basis event) will not credibly cause failure (i.e., opening) of more than one cf many fail-safe AOVs located in redundant safety systems.

d.

For the valves in nonredundant trains, describe why a random failure (i.e.,

opening) does not have to be assumed concurrent with a design basis event (include a discussion of what failures you conclude are noncredible).
