SUBJECT: NRC INSPECTION REPORT 50-298/98-08 AND NOTICE OF VIOLATION

Dear Mr. Horn:
From November 15 through December 26,1998, an inspection was conducted at your Cooper
'
Nuclear Station reactor facility. The enclosed report presents the scope and results of that
inspection.
During this inspection two violations of NRC requirements were identified. In the first violation,
inspectors identified that on four occasions your staff failed to follow procedures (two in
Operations, one in Maintenance, and one in Plant Support). We are concerned that these

examples could be a precursor indication of a return to procedural adherence problems. The
i
second violation involved inadequate corrective actions which were implemented to prevent
j
recurrence of the inadvertent opening of a torus-to-drywell vacuum breaker. This violation
i
'
concerns us because your staff did not take reasonable corrective action for s previously
identified violation. A compounding factor is the similarity of this problem to previously
documented weakness in applying information available in design and licensing documents
when correcting identified deficiencies. Because of our concern about the repetitive nature of
these violations, we are requiring a response to these violations. In addition, we intend to

discuss these concerns with you during our upcoming meeting on February 24,1999.
The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances
surrounding these violations are described in detail in the enclosed report. Please note that you
are required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine
whether further enforcement action is necessary to ensure compliance with regulatory
requirements.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter,its
enclosures, and your response will be placed in the NRC Public Document Room (PDR).
