i approve the staffs final Memorandum of Understanding (MOU) with the Department of Energy. However, I agree with the Chairman that certain revisions will be appropriate for consideration after our experience with Lawrence Berkeley National Laboratory. At the time of the revision to the MOU, I recommend the following changes.
1.
The staff should re insert language, similar to what was in the draft MOU, that allows DOE and NRC to seek legislation for NRC regulatory authority for a I
specific pilot facility or class of facilities once sufficient information is obtained from the pilot program. I believe it is important that legislation in this matter is sought at the cariiest appropriate time.
2.
The staff should make the following editorial changes:
Page 9,5th linn from the bottom: A comma should be placed before and a.
after tne phrase "as aopropriate". The comma after the word " briefings" l
should be removed b.
Page 9, last line:,.dd a hyuhen between the words "two" and " year" Page 11, Vill (c): Remove the comma after the word " independently" c.
