GENERIC APPLICATION FOR SUPPLEMENTAL STANDARDS FOR DURANGO PAVED STREETS AND ALLEYS l

Dear Mr. Rael:

The U.S. Nuclear Regulatory Commission stafi has completed its review of the Vicinity Property Radiological and Engineering Assessment (REA) for Paved Streets and Alle) :. Durango, Colorado, submitted by the U.S. Department of Energy (DOE) August 12,1997. DOE requested that the NRC review and approve the Generic Application for Supplemental Standards (GASS) portion of the REA. DOE subsequently provided the Certification Review Summary for thio group of properties by letter dated January 26,1998. After review of these documents, the NRC staff is providing concurrence on the application of supplemental standards, as described in the GASS.

The DOE GASS applies to approximately 19,000 cubic yards of residual radioactive material (RRM) overlain by paved streets and alleys, represented by 70 properties included in the Uranium Mill Tailings Remedial Action Project. The quantity of materialis based upon limited information because of the cost and safety risk of obtaining additional characterization data.

DOE haw concluded that there are no significant identifiable health risks associated with the RRM remaining under the Durango paved streets 9d al'eys, therefore, DOE proposes to apply supplemental standards (no remediotton) to those reas based on the unreasonably high wst (six million dollars) of remediation relative to the long term health benefits, as a!! owed under criterion c of 40 CFR 192.21.

l The NRC staff determined that the GASS meets the U.S. Environmental Protection Agency's criterion c for application of supplemental standards and the NRC Review Form for Supplemental Certification of Vicinity Properties is enclosed. However, the staff also considers that there should be some assurance that, when the RRM is excavated during street or alley pu g/

realigned or abandoned, or when utility lines buried beneath the streets are exposed, some control measures should be present to reduce radiation exposure, in order to assist with the Wg.L{$
