PROPOSED LNFORCEMENT ACTION - PUBLIC SERVICE ELECTRIC AND GAS COMPANY (PSE&G) (SALEM)
Attached for your review and concurrence is a proposed enforcement action (letter and Notice of Violation and Proposed Imposition of Civil Penalties) to PSE&G for numerous violations of NRC requirements identified during four inspections at the Salem facilities between December 5,1994 and June 23, 1995. The staff proposes cumulative penalties of $600,000 for the violations. Several of the violations involved the continuing failure to promptly identify and correct conditions adverse to quality at the facilities. The specific violations are described in detail in the attached proposal.
The cumulative penalty is based on individual $100,000 penalties for several Severity Level III violations or problems. In each case, the staff proposes the exercise of enforcement discretion and issuance of the individual $100,000 penalties to appropriately reflect the NRC concern regarding the violations and convey the appropriate message to the licensee, in view of the previous Salem enforcement history, the fact that the majority of the violations were identified by the NRC, and the fact that the licensee's corrective actions (to ensure problems are identified and corrected in a timely manner) were not prompt and comprehensive. This proposal was reached at a caucus following the predecisional enforcement conference on July 28, 1995, which was attended by Mr. Joe Gray of your staff.
