Dear Mr. McGovem:
I am _ writing in response to your requeist, dated December 4,1997, to amend the decommissioning plan for Cintichem Inc.'s Tuxedo, New York, facility to reduce the off-site environmental monitoring program. Your rationale for this request is that the off-site -
environmental monitoring program is no longer necessary, as all remediation work at the site.
has been completed. As such, the Order Authorizing Dismantling of Facility and Disposition of Component Parts, issued on November 21,1991, has essentially been completed. Per a phone conversation between Nuclear Regulatory Commission and Cintichem staff on -
January 21,1998, we understand that the only radioactive material currently on site consists of seven drums of material that may be classified as mixed waste, approximate iO cubic feet of
, miscellaneous activated and contaminated pieces of equipment that has bee, ackaged in a

Periodic in$pections conducted during decommissioning activities verified Cintichem's programs to control releases of radioacNe material to tne environment and your programs were '

Some inspections, most recently in August 1997, specifically verified the performance and results of the environmental monitoring program specified in the decommissioning plan, in all cases, these inspections indicated that sampling locations and collection frequenciec were proper and laboratory analysis of environmental sa;r.ples indicated decommissioning activities did not result in off-site
~ radioactivity or exrosure above typical background levels in addition, NRC maintains a network of off-site unvironmental thermoluminescent dosimeters (TLD) around the Cintichem n
site whien are collected and processed quarterly. Data from these TLDs has not detected an s increase in off-site exposure above normal background due to decommissioning aciivities.

Based on these factors, your license is amended to incorporate your request. A copy of the amendment is enclosed.
NRC staff has determined that this amendment providea for: (i) no significant change in the types, or significant increase in th e amounts of any effluent that may be released off site; (ii) no significant increase in individual or cumulative occupational radiation exposure; (iii) no significant construction impact; and (iv) no significant increase in the potential for, or -
consequences from, radiological accidents.' Therefore, in accordance with 10 CFR 51.22(c)(11), neither an environmental assessment nor an environmental impact l
statement is warranted for this action.
