Mescalero Apache Tribe P.0, Box 176 Mesca'ero, NM 88340 Dear Mr. Peso; Notice is hereby provided that your Quality Assurance (QA) Program Approval for Radioactive Material Packages, Approval No. 0817 is hereby terminated based on nonpayment of annual fees for the past two years (Invoice Nos. AM5140-96 and AM5363-97).
If you are a Nuclear Regulatory Commission licensee and conduct activities under the General Licenses of Subpart C of 10 CFR Part 71, or an Agreement State Licensee subject to the requirements of 10 CFR Part 71, as required by 10 CFR S 150.20, a OA Program approved by the Commission as satisfying the provisions of Subpart H of 10 CFR Part 71 is required Since you no longer have a valid QA Program Approval, the General Licenses of Subpart C of 10 CFR Part 71 and registration under the provisions of 10 CFR S 71.12, to transport or deliver licensed material to a carrier for transport are terminated.
Please note that records required by 10 CFR SS 71.91 and 71.135 are to be retained for a period of three years.
