AFFIDAVIT OF KENNETH T. KOSTAL I, Kenneth T. Kostal, being first duly sworn, do hereby depose and state as follows:

1. I am employed by Sargent & Lundy (S&L) in the capacity of project director for the Braidwood Project and as Assistant Manager of the Structural Department. I am a graduate of the University of Illinois with bachelor's and master's degrees in Architectural Engineering. I have 20 years of experience in the field of civil engineering, incDiding civil, architectural, and struc-tural engineering and design work for fossil and nuclear power plants. As a structural engineer, I have performed numerous calculations and assessments relating to the design of structural steel. Prior to joing S&L in 1967 I was engaged by the University of Illinois as an instructor in structural design.
2. I am a registered structural engineer in the state of Illinois.

I am also a registered professional engineer in 31 states includ-ing Alberta, Canada. I am presently a member of various struc-tural organizations, including the American Institute of Steel 8607090270 860701 PDR ADOCK 05000456 O PM

Construction, the American Concrete Institute, the American Society of Civil Engineers and the Structural Engineers As-sociation of Illinois.

3. I was assigned by Sargent & Lundy to the Byron and Braidwood Project as the Structural Project Engineer in 1973. During this time the Byron and Braidwood Structural Project Design Criteria were prepared, reviewed and issued. As Structural Project Engineer I had the responsibility of performing the review function for that document. That document formed the basis for the initial design of the structural steel at Byron and Braidwood Stations. In 1976 I became the Senior Structural Project Engineer, having overall responsibility for all civil, structural and architectural work associated with the project.

In this role, I became the approver of all changes to the design criteria. In 1979 I became the Assistant Manager of the Structural Department and Chairman of the Structural Standards Review Com-mittee. In this role I provided a review / approval function for all structural standards developed within the department, including those standards which govern the design associated with structural steel and the final load check of structural steel.

4. I have reviewed the Motion to Admit Late-Filed Contention on Overstress of Structural Columns and the two page anonymous letter attached to it. I wish to explain that a controlled program has been established and effectively implemented to assure that the structural steel at the Braidwood Station, including both beams

and columns, has been designed and assessed for all loadings and to assure that no structural steel members, and in particular columns, are overstressed.

5. The initial structural steel design performed by S&L for the Braidwood Station accounted for estimated loads from systems and equipment, along with all other applicable structural loads, such as dead, live, snow, seismic, wind, and construction loads.

In addition, for columns, a contingency load was included in the design and applied to the top of each column to account for the installation of future equipment, which we knew would occur but were unable to address specifically in the design because the size, location, etc. of the equipment were not known at that time.

This initial design was performed in conformance with the S&L Structural Project Design Criteria DC-ST-03-BY-BR issued on October 10, 1974. This initial design has been reviewed, checked, and audited to assure its completeness and that the structural steel beams and columns can accommodate the various loadings within code allowables and in conformance with all licensing committments. Since the initial design and installation of structural steel, the detailed design of mechanical and electrical systems has proceeded. Actual loads from installed components and systems have been recorded and maintained and have been accounted for in the evaluation of the structural steel for its final loading conditions. Modifications to structural steel beams and columns have been made, when required, to accommodate dif-ferences between the original estimated loads and the final as-built loads.

6. Thus, in our normal design process, an initial design based on estimated uniform loads is followed by a final load check based on actual as-built loads. The structural steel at the Braidwood Station, including both beams and columns, must be evaluated to assure that the state of stress in each member remains within code allowable stresses after accounting for the changes which may have occurred between the initial steel design and the final as-built configurations. This evaluation is accomplished during the " Final Load Check," a requirement that has existed for Braidwood since 1974. The Final Load Check evaluation of structural steel for all loads has been on going to assure that the final-installation will remain within code allowables and meets all regulatory requirements.

This program will be completed prior to fuel load.
