RESPONSE OF THE STATE OF NEW HAMPSHIRE TO SEACOAST ANTI-POLLUTION LEAGUE'S OBJECTION TO MOTION TO WITHDRAW CONTENTION NH-10 On June 12, 1986, the State of New Hampshire sought this Board's leave to withdraw Contention NH-10 from further consideration in this proceeding.
As grounds therefore, the State asserted that its concerns had been satisfactorily addressed in the Applicant's written submissions to the NRC Staff and the Staff's review of those DCRDR and SPDS materials.
The State's action signifies no " retreat" from its " commitment to protect public health and safety."
See SAPL's June 19, 1986 Objection to Motion to Withdraw Contention NH-10 at p. 5.
The State's involvement throughout this proceeding, in fact, belies this gratuitous, characterization of the State's motion.

. As to the merits of SAPL's objection, the State takes no position on whether Contention SAPL Supplement 61 is an independently sustainable contention.
Respectfully submitted, THE STATE OF NEW HAMPSHIRE STEPHEN E. MERRILL ATTORNEY GENERAL Dated:

lIn this contention, SAPL adopted as its own, inter alia, Contention NH-10.
If the Board finds that SAPL has preserved this Contention, its proper appellation will remain SAPL Supplement 6, and not NH-10.
