PROPOSED IMPOSITION OF CIVIL PENALTIES - $65,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $65,000 will be issued on or about July 7,1986 to Public Service Company of Colorado. This action is based on numerous security violations, two of which involve potential pathways for unauthorized, undetected access from the owner controlled area into the protected area and a vital area. Separate civil penalties were assessed for these two violations because they involved different root causes. The civil penalties were mitigated by 50% because of the licensee's prior performance.

However, further mitigation was not warranted because of the multiple examples of the violations identified, the duration of one of the violations, and the significance of one violation which was categorized at Severity Level II.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice July 7, 1986 Telephone Notification of Licensee July 7, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Colorado will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
