under Contract No. NRC-04-95-065 In accordance with Section G.5(c) of the subject contract, this letter definitizes the subject task order. This effort shall be performed in accordance with the enclosed Statement of Work and the contractor's technical proposal dated December 11,1998, which is hereby incorporated by reference and made a part of the subjr:ct task order.

Task Order No.18 shall be in effect for one year from the date both parties have signed this document. The total estimated ceiling for this task order is $17,824.

3 Task' Order No.18 Amending Financial Protection Requirements For Permanently Shutdown Nuclear Power Plants NRC-04-95-065 Technical Assistance For Rulemaking Support i

BACKGROUND

' The Commission directed the staff to initiate rulemaking activities for financial protection requirements for permanently shutdown nuclear power reactors in accordance with the recommendations as specified in SECY-96-256.. ICF was contracted (Contract No. NRC-04-95-065, Task Order No.9) to support the rulemaking effort and provided supporting documentation to allow the staff to proceed with a proposed rule. Subsequent events overtook the basis outlined in the proposed rulemaking package and the rule was placed on hold until additional technical issues were considered and resolved. As a result, the Task Order No. 9 with ICF expired. The staff is ready to proceed with a revised rule package and is requesting technical support from ICF to assist the staff in finalizing the proposed rule package that would amend 10 CFR 50.54(w) and 10 CFR 140.11 to provide relief to nuclear power reactor licensees for financial protection requirements for power reactor facilities that are permanently shutdown and in the process of decommissioning.

OBJECTIVE For the contractor to provide technical support to the NRC with regard to rulemaking activities related to amending financial protection requirements for permanently shutdown nuclear power reactors. The contractor will provide the NRC with supporting documents and technical assistance that will be part of the rulemaking package for Commission approval.

j WORKSCOPE The contractor shall initiate work to develop, amend, or revise existing supporting information that had been prepared previously (Contract No. NRC-04-95-065-009) by ICF for the proposed rule. The contractor shall revise the previously submitted Regulatory Analysis, Environmental Assessment, and OMB paperwork reduction package in conformance with the ctaffs content in the revised proposed federal register notice that discusses the structure of the proposed rule initiative. The contractor shall also provide a backfit analysis report to support the rulemaking initiative. The above documents shall be prepared in accordance with the most recent guidance, e.g., " Regulatory Aaalysis Guidelines of the U.S. Nuclear Regulatory Commission," N'JREG/BR-0058, Revision 2.

The contractor shall also plan for 1 day assistance for staff presentations with ACRS and CRGR meetings.
