Dear Mr. Vincent:

In October of 1984 you received a Federal Register Notice of Proposed Rulemaking (49 FR 39168) to amend 10 CFR Part 34, Licenses for Radiography and Radiation Safety Requirements for Radiographic Operations. The proposed rule was partly in response to your Petition for Rulemaking submitted to the NRC in September of 1982. In your petition you proposed that an additional survey of radiographic exposure devices be performed whenever a device was placed in storage, and that the record keeping requirement be changed from the "last-use" survey to the new " time-of-storage" survey.

As a result of public comments and staff analysis, the Commission has decided to grant your petition. Enclosed for your information is a copy of Federal Register Notice (51 FR 21736) on a final amendment of 10 CFR Part 34. The amendment provides a definition of " Storage Area" (934.2), requires that a survey be made at any time a radiographic exposure device is placed into storage (934.43(c)), and requires that a record be made for the storage survey when it is the last one performed during the work day (534.43(d)).

On behalf of the Commission and myself, I want to express our appreciation to you for your interest and efforts in improving the radiography ;afety regulations. I believe that your petition and the subsequent rulemaking process has resulted in a significant improvement.

Sincerely,

=.,
