Dear Mr. Alderson:
In accordance with our telephone conversation yesterday, here are copies of the Federal Register notices extending the public coment period for the Draft Environmental Statement for decommissioning Humboldt Bay Power Plant, Unit No.
3; and for an opportunity for a prior hearing on the relevant license amendment and decommissioning plan.
As I indicated to you, the Nuclear Regulatory Commission (NRC) does not intend to hold a public meeting for the purpose of receiving coments on the Draft Environmental Statement (DES). The public is encouraged to provide written coments to the NRC by August 15, 1986. Such comments will appear verbatim in the Final Environmental Statement (FES) along with appropriate responses.
In addition, each comentor will receive a copy of the FES when it is issued.
A public hearing, in the context of the NRC Regulations, is a formal adjudicatory process, before an Atomic Safety and Licensing Board (ASLB).
Such a hearing is held regarding the licensing action proposed, not the Environmental Impact Statement (DES or FES). The FES among other things is offered in evidence by the NRC Staff at such a hearing and is subject to cross examination by the parties to the proceedings. The procedure for requesting such a public hearing is set forth in the notice for opportunity for prior hearing, enclosed.
Individuals, organizations, agencies, etc., should submit their coments on the DES for the Humboldt Bay Unit No. 3 decomissioning in writing prior to the close of the coment r eriod.
In that way they can be assured of publication of the coments and response thereto. Your interest in this process is appreciated.
