Dear Mr Smolski:
This refers to your telephone conversation with Duncan White of this office on October 26, 1995 concerning the transfer of generally licensed fixed gauges from one location to another.
Title 10, Part 31.5(c)(3) of the Code of Federal Regulations {10 CFR 31.5(c)(3)} requires that the installation, servicing, and removal from installation involving radioactive material, its shielding or containment be performed by a person holding a specific license pursuant to 10 CFR 30 and 32 or from an Agreement State to perform such activities. A copy of this regulation is enclosed with this letter.
As a general licensee, you are not authorized to service or remove from installation radioactive material or its shielding and containment. The two LFE gauges that you wish to transfer to another facility can only be removed from service and transferred by a person specifically licensed by the NRC or an Agreement State.
Failure to comply with 10 CFR 31.5(c)(3) is a violation of NRC regulations and could result in the NRC taking enforcement action in accordance with 10 CFR Part 2.
