Dear Senator Bentsen:

I am pleased to respond to your letter dated June 5,1986 to Mr. Carlton C. Kammerer, in which you requested us to provide you with information related to an inquiry from a constituent, Ms. Downs. A copy of that inquiry is enclosed for your reference.

The constituent requests your support in preventing NRC from allowing the

,Sh_orehgn Nuclear Station to start operations. The NRC rules and regulations provide for individuals to intervene in the licensing process and to bring forth contentions on pertinent public health and safety and environmental issues. Since the spring of 1982, extensive hearings on intervenor's contentions have been held regarding the Long Island Lighting Company's (LILCO's) application for an operating license for Shoreham. With respect to all contested environmental and health and safety issues other than offsite emergency planning, the Commission and its adjudicatory boards have determined that the Shoreham facility is in compliance with Federal laws and regulations and may be licensed to operate. On that basis, and because offsite emergency planning is not required for low power operation, a low power license (for power levels up to 5% of rated power) was issued to LILC0 in July 1985. At the NRC, we appreciate the concerns raised by interested members of the public regarding the operation of the Shoreham Station and recognize our important responsibility for protecting the health and safety of the public. The Shoreham Station will not be licensed for full power operation until the offsite emergency planning issue is satisfactorily resolved and the NRC finds reasonable assurance that the public health and safety would not be harmed by that level of service.

The NRC is not "... moving towards deregulating the nuclear industry" as asserted by Ms. Downs. We are striving to streamline the licensing process to avoid those delays which do not have any real merit in enhancing the assurance of public health and safety. However, this kind of effort is entirely different from "... deregulating the nuclear industry." On the contrary, safety related regulatory requirements for nuclear power plants, especially since the Three Mile Island accident, have become much more extensive and stringent. Except for the emergency planning issue, which remains pending, we have determined that the Shoreham Station complies with these additional safety improvements, and that all applicable NRC regulations are being met.

We believe that it could be better addressed by the Department of Energy, which is also responsible for managing the solar energy program.

However, we understand that in Fiscal Year 1986, $685.8 million was appropriated to the Department of Energy for energy conservation and renewable energy sources. Of this amount $144.7 million was to be applied specifically tosolarenergyhIntheFY1987 budget,thepresidenthasrequested$247.9 million for consertation and renewable sources, of which $72.3 million would apply to solar energy. The exact amount approved will, of course, be determined by the Congress.
