SUBJECT: NRC INSPECTION REPORT NO. ;0-440/97007(DRP) AND NOTICE OF

VIOLATION

. Dear Mr. Myers:

On June 23,1997, ihe NRC completed an inspection at your Perry 1 Nuclear Power Plant.

= The enclosed report presents the results of that inspection. A follow up exit meeting was

conducted on October 10,1997, to provide additional information pertaining to identified

violations.

Operation during this period was characterized by a number of power changes to

accommodate malntenance activities and core management. One automatic reactor

shutdown also occurred. The power maneuvers were controlled well by control room

operators who also responded well to the automatic reactor shutdown. However, a number

of events occurred during the period which appeared to have personnel errors as a cause.

For example, the Division 3 Emergency Diesel Generator and High Pressure Core Spray

Pump automatically started when a technician inappropriately adjusted a valve. The

automatic reactor shutdown also appeared to have been caused by a failure to install a

gaAket on an electrical connection box.

,,, addition to these concems, a violation of NRC requirements was identified during the

inspection. The violation included three examples ofinappropriate procedures or

instructions. After your staff identified that the reactor mode switch had not been locked as

required by the Technical Specifications Bases, the NRC identified that the requirement had

not been incorporated in an operating procedure or instruction. You also identif'ed an

example that involved your staff's failure to verify the placement of a required personnel

safety tag before removing a non-s3fety-related valve from service. A third example

invo!ved NRC identification that the test procedure for leak testing emergency closed

cooling water valves was not appropriate. While neither of the examples resulted in a direct f

degradation of plant safety nor were indicative of a programmatic breakdown, the violation

is of concern because of the importance associated with the control of plant activities ')

~ affecting quality through the use of appropriate and effective procedures or instructions.

The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding the violation are described in detail in the enclosed report. Please note that

.you are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements.
