l am responding to your December 22,1998, memorandum concerning the " Plan for Protecting l

Nuclear Weapons information."

Because of the relatively small number of classified records at the NRC which are 25 years old or older, we are conducting a page-by-page review of all records subject to the declassification provisions of Executive Order 12958 (E.O.), " Classified National Security Information."

Therefore, the proposed plan will have no impact on our current methodology as delineated in the NRC's Declassification Compliance Plan submitted to the Director, Information Security Oversight Office (ISOO) on October 10,1995, and approved by ISOO on October 25,1995.

We do not anticipate resource costs beyond those already committed to the completion of the 5-year review.

j NRC staff involved in reviewing records under the provisions of Section 3.4 of the E.O. will participate, as appropriate, in the training offered by the Department of Energy.

Plan for Protecting Nuclear Weapons Information I

'Section 3161 of the FY 1999 Defense Authoritation Act required that the Administration develop a plan to prevent the inadvertent release of records containing nuclear weapons information (so-called Restricted Data (RD) and Formerly i

Restricted Data (FRD)) during the automatic ceclassification of 25 year old records under Executive Order 12956, In signing this Act on October 17, the President shared tha*:

I am committed to submitting the plan required within 90 j

days.

In the meantime, I will interpret this provision in a

a manner that will ensure the maximum continuity er agency efforts, as directed by my Executive Order 12950, to L

declassify historically valuable records.

I Representatives from DOE, NARA (including ISOD), 5t, ate, DoD, CIA, OMS, and N3C staff have drafted a plan tnat fulfills the requirements of the legislation as well as the President's j

i priorities.

The principal features of the Plan are as follows:

Agencies will evaluate collections of 25 year old reccrds that l

are not acheduled for a page-by-page review to " certify" those j

that are " highly unlikely" to contain RD and FRD.

All others will ce reviewed page-by-page, until agencies are able to make l

the needed certification.

l All agency otoff involved in declacoifying 25 year old records l

will receive DOE training to enable them to identify RD and FRD.

Most will attend a one-day training session while more advanced 5-day training will be given to the agency staff who review collections thought to contain RD and FRD.

Agencies already committed to a page-by-page review for all 25 year cid records, such as State, CIA, and nest uf DoD, will experience little change beyond the required training.

To assist us in complying with the Trealdent's intention to submit a Plan to Congress by January 19, 1999, we reques: your comments on the attached draft Plan by December 31.

It is particularly important that you adv;se us of any anticipated problems of implementation and provide your best estimate of the cost of imp *.amanratinn.
