ENCLOSURE 1 NOTICE OF VIOLATION Westinghouse Electric Corporation Docket No. 70-1151 Columbia Nuclear Fuel Plant License No. SNM-1107 As a result of a Nuclear Regulatory Commission (NRC) inspection conducted on February 24-28, 1986, the following violations of NRC requirements were identified. The Severity Levels were assigned in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C).

1. 10 CFR 71.5(a) required that a licensee who transports licensed material outside the confines of his plant or other place of use, or who delivers licensed material to a carrier for transport, comply with the applicable requirements of the regulation appropriate to the mode of transport of the Department of Transportation (DOT) in 49 CFR Parts 170 through 189.

49 CFR 173.427(c) required that the -internal contamination levels not exceed 100 times the limit specified in 49 CFR 173.443(a) for any packaging which previously contained radioactive meterials and has been emptied of contents as far as practical and which has been excepted from the Departme.nt of Transportation (DOT) marking and labeling requirements. 49 CFR 172.202(a)(3) required that the material identification number prescribed for the material in 49 CFR 172.101 or 102 be included in the shipping description of a hazardous material on the shipping papers.

Contrary to the above, Department of Transportation requirements were not met for shipments of tankers on May 14 and October 22,1985,(two

~s hipments made each day), in that:

l a. Appropriate surveys were not performed to demonstrate that the internal contamination levels were less than the

! established limit. The tankers had been excepted from marking and labelling requirements of DOT.

b. The correct identification number prescribed for the material was not included in the material description on the shipping papers.

!- This is a Severity Level IV violation (Supplement V).

2. License Condition No. 9 required that licensed material be used in accordance with statements, representation, and conditions contained in l

Chapters 2, 3, and 4 of the application dated March 26, 1984, and supplements thereto. Section 2.3.1.9 of the license application stated that the storage of license material shall be subject to one or more of l the following controls: (1) nuclear criticality safety postings with 9604090116 060328 PDR ADOCK 07001151 C PDR t -

~ Contrary to the above, on February 27, 1986, licensed material was stored in' containers which were not authorized by the criticality safety postings for the storage area.

This is a Severity Level IV violation. (Supplement VI)

Pursuant to 10 CFR 2.201, you are required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged violations; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Security or safeguards information should be submitted an an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
