. BACKGROUND: .

In SECY 94-176, the staff sought Comission approval to issue for public coment a proposed rule for shutdown and low power operation at nuclear power plants. The Comission approved the recuest in the staff requirements memorandum dated September 12, 1994, anc the proposed rule was published in the federal Register in October 1994. The numerous comments received were considered along with Comission guidance regarding the use of a risk-informed, performance-based approach for new regulations. As a result, the staff made significant changes to the proposed rule and regulatory analysis. In addition. the staff's studies of spent fuel storage pool operations led to a decision to encompass spent fuel storage pool o xrations i in the revised rule. DISCUSSION:

< L-4. ipr @ 'rtg r uyns The staff's revised regulatory analysis considered importan't safety functions and the controls currently in place to ensure these functions. For low-power operation hot shutdown, and the transition period from hot to cold shutdown, the revised analysis concludes that for these periods important safety functions are protected by existing requirements in standard technical specifications. Accordingly. the revised proposed rule no longer addresses these modes.

Commissioner Dieus: Comments on SECY-97-168 Although I still do not object to the basic request of the staff, these comments modify my earlier position on SECY-97-168.

The proposed actioil would have been a useful vehicle to solicit comments from the industry on a proposed shutdown rule. Regardless of the final form the rule may have taken, certain elements of the current proposal would have needed to be modified. For example, spent fuel pool operations and fire pih7 should not be covered by the shutdown rule, and these two areas should be eliminated from further staff consideration in this regard.

The staff should assess the regulatory efficacies of licensee voluntarv inn 41ves and actions. In tandem with this, the staff should establish and maintain a licensee commitment tracking system for regulatory use to track licensee voluntary initiatives and actions.

Additionally, the staff should evaluate the degree to which shutdown operations and risk can be controlled and assessed by application of the Maintenance Rule in its current form or in modifications to the Maintenance Rule that may be proposed.
