SUBJECT:
WITHDRAWAL OF NOTICE OF VIOLATION IN INSPECTION REPORT
NO. 50 341/97003(DRP)
Dear Mr. Glpson:
This refers to the inspection at Ferm12 described in the subject inspection Report issued on
July 1,1997. As a result of that inspection, a Notice of Violation was issued for failure to follow
radiological protection procedures. Specifically, Violation 50 341/9700313 was cited for failure
to receive a briefing of radiological conditions prior to performing work more than 8 feet above
the floor l') the Radiological Restricted Area (RRA).
The NRC has reviewed your July 30,1997, letter, * Reply to Notices of Viol & tion 97003 02,
97003-05,97003-07, and 970031' " In your letter, you provided your basis for disputing Notice
d
of Violation 9700313. After further review, the NRC acknowledges your position that the
requirements of the radiological work permit were met when the individuals received a
radiological briefing on the previous day, which was prior to beginning work in the Radiologically
Restricted Area. Additionally, the NRC agrees with your statement that the communicat;en
between the Rrdiation Protection Supervisor and the Nuclear Instrument Repairmen could have
been more thorough. The NRC understands that the Fermi Radiological Protection Conduct
Manuct Procedure has been clarified pertaining to the notification requirement for working more
than 8 feet above the ficor in the RRA. The NRC considers inis corrective action appropriate.
Based on further review of your procedures, the NRC agrees with your dispute of the violation
and is withdrawing the Notice of Violation 50-341/97003-13 by issuance of this letter.
No response to this letter is iequired. In accordance with 10 CFR Part 2.790 of the NRC's * Rules
of Practice," a copy of this letter will be piaced in the NRC Public Document Room.
