Dear Mr. Bendt:

In accordance with the task order procedures of the subject contract, this letter definitizes Modification No. 5 to Task Order No.11 for the performance of services as described in the attached Statement of Work. As a result, the task order ceiling amount is hereby increased by

$97,050.00 from $184,207.00 to 281,257.00. The sum of $259,637.00 represents the reimbursable costs and the sum $21,620.00 represents the fixed fee.

A summary of obligations for the subject task order, from award date through the date of this action is given below:

$60,000.00 The obligated amount shall, at no time, exceed the task order ceiling. When and if the amount (s) paid and payable to the Contractor hereunder shall equal the obligated amount, the Contractor shall not be obligated to continue performance of the work unless and until the Contracting Officer shall increase the amount obligated with respect to this task order. Any work undertaken by the Contractor in excess of the obligated amount specified above is done so at the Contractor's sole risk.

1.0 Background

This task is a follow-on to the expired Task 22 of Contract NRC-02-90-009. Task 22 was initiated in June 1993 to amend the Certificate of Compliance (COC) for the VSC-24 dry spent fuel storage cask (COC No.1007) to accommodate the storage of fuel control rod components with the fuel assemblies. The task was modified in December of 1993 to include new analyses on seismicity and dose versus distance calculations. Sierra Nuclear Corporation (SNC) submitted a request in August 1994 for several changes including an increase in maximum initial enrichment to 5.0% from 4.2%

and redesigned lifting lugs. The task was modified again in December 1994.

Since SAIC was not able to complete the required review under Task 22 when the task and contract expired, Task 11 was initiated to complete the unfinished portion of Task 22.

On June 28,1996, SAIC submitted the Task 11 contract deliverables to NRC (i.e., the draft Safety Evaluation Report (SER) and COC). The completion of the review was put on hold by the NRC because several issues involving the VSC-24 had emerged (e.g., hydrogen generation from coatings, weld problems, and drain-time limit). Subsequent to resolution of the weld and drain time issues, NRC requested that SAIC review the VSC-24 Safety Analysis Report (SAR) and compare it with the recently released " Standard Review Plan for Dry Cask Storage"(SRP, NUREG-1536) and any other applicable NRC guidance documents, and prepare questions. This request was l

documented under Modification 3 to Task 11.

On August 24,1998, SAIC submitted a contract deliverable to NRC (i.e., a list of questions related to the VSC-24 SAR, Revision 1). However, on October 8,1998, SNC requested a withdrawal of the Revision i submittal. In addition, SNC plans to submit an amended VSC-24 SAR Revision 1 in November 1998 and a Revision 2 submittalin May 1099.

Consequently, Task 11 requires modification to allow for continued technical support on the two upcoming VSC-24 amendment requests.

2.0 Objective The objective of this task is for SAIC to provide technical assistance to NRC in review of VSC-24 cask analyses to support SAR amendments to COC No.1007, and to provide technical support to NRC staff during the rulemaking process.

3.0 Technical and other Special Qualifications Required Technical expertise is required from: (1) individuals that provided technical review input in past NRC l

submittals or (2) individuals that are thoroughly familiar with specific technical aspects of the VSC-24

4.0 Period of Performance s.

The period of performance of this task commenced on February 20,1996, and shall expire on December 31,1999. The effort described in this revised statement of work shall begin once the modification is signed by both parties.

5.0 Scope of Work The contractor shall provide technical assistance in the following areas to the NRC:

i a)

Review technical analyses submitted by SNC regarding amendments to the VSC-24 SAR.

j Conduct appropriate confirmatory calculations to verify analyses. Assist NRC staff in j

preparing requests for additional information (RAls), as needed, to complete the review.

b)

Prepare a draft SER and COC. Attend Committee to Review Generic Requirements (CRGR) meeting, if needed. Prepare written responses to CRGR comments, and incorporate CRGR l

comments in the draft SER.

c)

Following the open comment period, provide written responses to technical comments from the public.

d)

Assist the staff in providing resolution to technical questions and comments from within the NRC during the rulemaking period.

e)

Perform a final review of the amended SAR to ensure that changes, additions, and deletions are properly reflected.

l 6.0 Meetings and Travel Meetings may be requested by the technical project manager (TPM) or SAIC on an as needed basis and may be held at NRC headquarters in Rockville, Maryland or SAIC's office in McLean, Virginia.

Three meetings at NRC's headquarters are anticipated, but if needed, attendance at one CRGR l

meeting at headquarters will be required. If during the review process, an area of review requires technical discussions with SNC, SAIC may be requested to attend. Therefore, assume one trip for two people to the SNC's facility in Scotts Valley, California.

l 7.0 NRC-Furnished Material l

The NRC's TPM will furnish copies of documents under Docket No. 72-1007 to SAIC.

i 8.0 Technical Progress and Financial Status Reports

The reports are due within 15 calendar days after the end of the report period.

9.0 Deliverables / Schedules The following deliverables shall be submitted to the TPM in accordance with the scheoule noted below.

All work assignments and program funding actions are initiated by the NMSS TAPM who submits all requests to the Division of l

Contracts "nd Property Management (DCPM) for processing. All proposed work scope or schedule l

changes must P.a submitted through the NMSS TAPM for DCPM.

The NMSS TPM is responsible for providing technical guidance to the contractor regarding staff l

interpretations of the technical aspects of regulatory requirements, along with copies of relevant l

documents (e g. Regulatory Guides) when requested by the contractor. All work products must be reviewed and app'oved by the NMSS TPM before they are submitted as final documents. All technical directions given to the contractor must be consistent with the work scope and schedule.

The NMSS TPM is not authorized to unilaterally make changes to the approved work scope or schedule or give tne contractor any direction that ' Ould increase costs over approved levels. The Contracting Officer is the only individual authonzed to make changes to this task.

11.0 Level of Effort The estimated level of effort to complete this task, as modified, is 5.0 months FTE (with an expet,ted 2

breakdown of approximately 4.0 months FTE in FY99 and approximately 1.0 month FTE in FY00).
