RE: Ex Parte Filing from Washington Legal Foundation

Dear Mr. Clements:

e I am writing in response to your memorandum of June 2, 1986 regarding the ex parte filing of a document entitled, Off-Sight Emergency Planning for Nuclear Power Plants: A Case of Government Gridlock. I thank you for your memorandum and for the copy of the study in question. I am in agreement with you that this document falls within the prohibitions of 10'C.F.R. 2.780. I would also like to note that this is not the first instance in which Robert Rader has provided such information to the Nuclear Regulatory Commission in an ex parte manner. During the course of the proceedings regarding 50-352 and 50-353, In the Matter of Philadelphia Electric Company (Limerick Nuclear Generating Station, Units 1 and 2), Mr. Rader provided Chairman Helen Hoyt with various articles of a similar nature. Ms. Hoyt appeared to ,

welcome these documents and thanked Mr. Rader for his concern.

The documents that I witnessed being given to Chairman Hoyt in-volved comments from various trade publications regarding what Mr. Rader perceived to be the " folly" of emergency planning requirements. This regular practice further contributed to the lack of an impartial tribunal which is an issue I have raised with regard to the Fourth Partial Initial Decision which is currently on appeal before the Atomic Safety and Licensing Appeal Board.
