Dear Ms. Stephens:

This is in response to your letter dated January 27, 1986, in which you appealed NRC's July 5, 1985, response to your letter dated May 1, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA),

Office of Investigations' (01) records on investigations related to Wolf Creek which occurred within the last year.

In your January 27 letter, you express a belief that NRC failed to respond to your F0IA request. Although we have responded to your request, we hope that the following explanation will clarify this matter.

In Mr. Felton's letter dated July 5,1985, we mistakenly informed you that documents that are subject to your request are also subject to your pending F0IA request F01A-85-101 and that the documents were located in 01 files 04-84-052, Q4-84-053, and 4-84-056.

In fact, documents that are subject to your request are also subject to F0IA-85-101, which we received from the Government Accountability Project (GAP), and are. located in 01 files Q4-84-052, Q4-84-053, and 4-84-026. Despite those errors in that letter, wTich we have underlined for clarification purposes, the subject records, contained in the three referenced files, were addressed in various response letters'we provided to GAP regarding F01A-85-101. Copies of those response letters and records that were disclosed are maintained in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555, in file folder j

F01A-85-101 under the names of Varricchio and Devine.

In your letter dated August 20, 1985, you stated that since F01A-85-101 is dated February 2, 1985, documents should he provided that are dated up to the date of receipt of your May 1,1985, request. The staff has informed me that in conducting their search for records that are' subject to F01A-85-101, they in fact included those that are dated up to the date of receipt of your request, as noted on the appendices to the response letters regarding i

F0!A-85-101.

-2 Lastly, this is to inform you that-while you referenced a number of NRC offices other than 01 in your letter, the subject to your request--records within 01 cases -did not involve any other office.

In light of this explanation,we are taking no further action on your appeal.

Sincerely, Donnie H. Grimsley, Director.
