ANNUAL REPORT TO CONGRESS FOR FISCAL YEAR 1998 Section 1701(b)(1) of the Energy Policy Act of 1992 (EPAct) requires that

"[t]he Nuclear Regulatory Commission, in consultation with the Department [of Energy] and the Environmental Protection Agency, shall report at least annually to the Congress on the status of health, safety, and environmental conditions at the gaseous diffusion uranium enrichment facilities of the Department." Gaseous Diffusion Plants for Fiscal Year 1998, presents information regarding i

Department of Energy (D0E) activities at the Paducah and_Portsmouth Gaseous i

Diffusion Plants (GDP) and is transmitted to the Nuclear Regulatory Commission (NRC) in furtherance of the EPAct consultation requirement.

This report discusses the status of environmental, safety, and health conditions for those portions of the GDP sites for which DOE retains oversight responsibility. Also, because DOE continued to regulate highly enriched uranium (HEU) activities during FY 1998, this report includes information on the DOE Regulatory Oversight program activities in the leased, but not

certified areas, at PORTS. This report also describes the HEU refeed, 1 lg suspension and removal, and transparency programs conducted by DOE and describes DOE Compliance Plan activities, the Nuclear Safety Upgrades program, and the Memorandum of Understanding employed by DOE and NRC to ensure h7 {T i

effective and efficient cooperation in our joint oversight activities conducted at the GDPs. The report also contains a brief discussion regarding modifications to the Lease Agreement Between the United States Department of Energy and the United States Enrichment Corporation.
