Therefore, we wish to request an amendment to license SNM-1713, a plutonium powered pacemaker license, transferring it to West Virginia University Hospital Inc.

Since the corporation is not, strictly speaking, an agency of state government, an amendment fee of $40.00 is enclosed under the provisions of 10 CFR 170.31, item 7.B.

The corporation is to Fegin operating the hospital on 1 July 1984, so your prompt consideration of this application is appreciated.

This refers to your May 22, 1984 requests for amendment to Licenses 47-01163-20,

-22 and SNM-1713, to transfer them to West Virginia Hospitals, Inc.

A fee of

$120 accompanied the requests.

Enclosed is a copy of the Comission's revised license fee schedule (10 CFR 170),

which became effective June 20, 1984. An amendment to License 47-01163-20 re-quires a fee of $120, as specified in fee Category 7B of $170.31.

(Wea511ed the $120 fee you recitted to the -20 amendment request).

An amendment to License 47-01163-22 requires a fee of $230 pursuant to fee Category 7A.

Accord-ingly, please remTt an amendment fee of $230 to the U.S. Nuclear Regulatory Com mission and mail it to my attention.

l Your request for amendment to License SNM-1713 does not require a fee since you j

currently hold a broad medical license (47-01163-20).

It has been our policy that, if a licensee holds a broad medical license, no fee is assessed for a e

l separate SNM pacemaker license. The issuance of a separate SNM license for a plutonium-powered pacemaker is done for the administrative convenience of the Conriission; accordingly, no fee is assessed therefor.

Your applications will be processed by the Region II Licensing staff located at 101 Marietta Street, Suite 2900. Atlanta, Georgia 30323. The fee, however, is required prior to issuance of the amendment. When submitting the fee, please refer to CONTROL NUMBER 50309.

FEE FOR MATERIALS LICENSES 47-23066-01 AND 47-20366-02 l

By letters dated May 22, 1984, West Virginia University informed the Commission that the West Virginia legislature had set up a corporation to administer West Virginia University Hospital. The University requested that Materials Licenses 47-01163-20, 47-01163-22, and SNM-1713 l

be amended to reflect West Virginia University Hospital, Inc. as the i-licensee and that a new license be issued to West Virginia University j

for the use of the materials that remained under the University's i

control. Since the exemption in 9170.11(a)(9) of 10 CFR 170 does not apply to the West Virginia University Hospital, Inc., amendment fees of

$120 and $230 were collected for the amendments to Licenses 47-01163-20

]

and -22 respectively. A fee was not required to amend License SNM-1713 j

a pacemaker license.

I For administrative reasons, the Licensing staff terminated Materials Licenses 47-01163-20,47-01163-22 and SNM-1713 and issued new Licenses l

47-23066-02, 47-23066-01 and SNM-1948 to replace them (refer to Earl Wright's letter dated 4/9/85). Since the issuance of the new licenses was initiated by the Licensing staff, and since amendment-type reviews were performed, the $120 amendment fee collected on August 8, 1984 is 4

the correct fee for the issuance of License No. 47-23066-02, and the j

$230 amendment fee collected on September 24, 1984, is the correct fee i

for the issuance of License No. 47-23066-01. License @M908, which j

replaced License SNM-1(Dl3, is exempt from fees since it~is'a pacemaker license and West Virginta University Hospital, Inc. holds nuclear medicine License 47-2306 -02.

New License 47-23035-01, which was issued j

to West Virginia Univers ty for the possession and use of the materials l

remaining under the Univ rsity's control, continues to be fee exempt 1
