SUBJECT:

REVISION OF REGULATORY GUIDE 3.46 The Uranium Recovery Branch (URB) recently developed a draft Standard Review Plan for in Situ Extraction License Applications (NUREG 1569), and is now requesting public comments through a Federal Register Notice. The Standard Review Plan was developed as a compliment to the existing Standard Format and Content Guide for in Situ Uranium Solution Mines, Regulatory Guide 3.46, published in June 1982.

During the course of the Standard Review Plan development, it became obvious that Regulatory Guide 3.46 contained references and regulatory citations that are out-dated, given the 1993 revision of 10 CFR 20 and the finalization of several draft Regulatory Guides. In addition, Regulatory Guide 3.46 references several staff technical positions which are now superseded by the guidance in NUREG 1569.

URB staff have been working with Ann Beranek of your staff to determine the most expedient way to update Regulatory Guide 3.46 and publish a revised draft for public comment. At Ms.

Beranek's recommendation, URB staff revised an electronic version of the Regulatory Guide and included a line-in/line-out version to highlight the proposed changes. These documents and a summary of the revisions are provided as attachments, along with a disk containing the Wordperfect 5.1 file of Attachments 2 and 3. It is our understanding that your division willissue i the Federal Register Notice announcing the availability of the revised Regulatory Guide for l comment, and coordinate receipt of any comments. Please let me know if there is any additional support we can provide once comments are received.

NUREG 1569. This document incorporates and supersedes the guidance provided in  !

the older technical positions. .

Citations to 10 CFR 20 have been updated for consistency with the numbering in the new Part 20.

. A new section describing Renoiratorv Protection and Controls has been added. This reflects the addition of respiratory protection programs in the new Part 20.  ;

f Additional recommendations for Presentation of Information have been added to  :

facilitate page changes and tracking the resolution of technicalissues during the  ;

application review process. .

The name 'in situ uranium solution mining

  • has been changed to *in situ uranium solution extraction" throughout the document to be consistent with the nomenclature in i 10 CFR 40 and NUREG 1569. s i
