Dear Govemor Kitzhabor:
In responso to your December 8,1997, request to relinquish Orogon's authority to evaluato and approve scaled source and device (SS&D) applications, I askod the Nuclear Regulatory Commission staff to preparo a paper on the issue so that the Commission could act on your roquest. The staff is currently developing such a pa,*er. Attor reviewing your proposal and the staff's analysis, the Commission will make a decision whether or not to roassume regulatory authority for SS&D ovaluations and approvals within the State of Oregon. The nood to evaluato your request, rocolve Commission approval, and plan for an orderly transition, did not enable us to rosume authority on January 1,1998, as you proposed. We anticipato Commission action in the near futuro. With positivo Commission action, resumption of NRC authority could be planned for the Spring of 1998. We will notify you when the Commission has acted on your request.
