Gentlemen:
Joseph M. Farley Nuclear Plant - Units 1 and 2 NRC Invoice for Review of Part 50 Applications By Invoice Number E0588, the NRC informed Alabama Power Company of the NRC costs associated with the period December 1984 through June 1985. Enclosed is a check for $7,658.00 for costs related to Alabama Power Company applications dated August 16, 1984, November 2, 1984, January 2, 1985 and March 13,1985. The $4,402 invoice for Alabama Power Company's April 19, 1985 submittal is not considered to be an appropriate charge and is hereby appealed.
The basis for the appeal of the costs related to the April 19, 1985 submittal is that this submittal was not an amendment, exemption, relief or other related approvals request. The April 19, 1985 submittal merely responded to a January 31, 1985 NRC request for information. This type of NRC activity falls beyond the scope of 10CFR170.12(c) and 170.21.
