IMPOSITION OF civil PENALTY - 52,500 By EN 97-049 ia'ed June 10,1997 the Commission was notified of the intent of OE to issue a Notice vi"iolation and Proposed imposition of Civil Penalty (Notice) in the amount of $2,500 m Westa Colorado Testing, Inc. This action was based on a Severity Level 111 violation involving r willful failure to file for reciprocity before conducting NRC licensed activities in areas e.1 der NRC jurisdiction.
The licensee respondeo to the Notice in a letter dated July 16,1997. After careful consideration of the licensee's response, the staff has concluded that: (1) the violation did occur as sat fort >. in the Notice, and (2) the licensee did not provide an adequate basis for mitigation of the civil penalty.
Accordingly, an Lder imposing Oivil Monetary Penalty in the amount of $2,500 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
