PROPOSED IMPOSITION OF civil PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $50,000 will be issued on or about October 14,1997 'o Northern States Power. This action is based on e Severity Level 111 problem involving four violations pertaining to the Prairie Island staffs failure to establish an Inservice Test (IST) procedure acceptance criteria that would not compromise the auxiliary feedwater (AFW) system design basis requirements, to implement corrective actions when incorrect acceptance criteria for a safety injection pump IST procedure were identified, to analyza a discrepancy between the Updated Safety Analysis Report (USAR) and the anticipated AFW flow, and to maintain the fidelity of the USAR.

According to the Enforcament Policy, a base civil penalty for $50,000 is considered for a Severity Levelill problem occurring before November 12,1996. Because the majority of the period of

- noncomoliance occurred prior to Novernber 12,1996, a civil penalty in the amount of $50,000 is being proposed. Because this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for identification and corrective actk,n. The NRC determined that credit was not warranted for Identification since these violations were identified by the NRC or the plant staff identified the violation but failed to recognize the significance until prompted by the NRC. The NRC determined that credit was warranted for Corrective Actions.

i Therefore, a base civil penalty of $50,000 is being proposed for the Severity Level til problem.

it should be noted that the licensee has not been specifically informed of the enforcement action.

- Telephone Notification of Licensee October 14,1997 The State of Minnesota will be noti'ied.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
