Based on your telephone call yesterday, I understand that the U.S. Environmental Protection Agency (EPA) plans to issue Federal Guidance Report No.13 (FGR 13), Health Risks from Low-Level Environmental Exposure to Radionuclides, for interim use and comment. As discussed in our December 31,1997, letter,'ve fully support this approach.

As my staff discussed with you and your staff yesterday, NRC looks forward to assisting EPA in reviewing and resolving any comments received on FGR 13 during the comment period. Dear Mr. Weinstock:

I appreciated the opportunity, yesterday, to discuss our remaining concems regarding the U.S.

Environmental Protection Agency's (EPA's) proposed publication of Federal Guidance Report No.13 (FGR 13), Health Risks from Low-Level Environmental Exposure to Radionuclides.

As you are aware, our agencies, along with the U.S. Department of Energy, have cooperatively funded and worked together to develop the technical basis for FGR 13, with a goal of ensuring that future asse=sments of potential risks from radiation would be performed properly and consistently across the nation. In Seotember 1997, U.S. Nuclear Regulatcry Commission representatives to the FGR 13 working group provided significant technical comments, as well as policy concerns, about the validity a'x,' usefulness of the document for licensees, regulate's, and the public, After a review of the December 1997_ version of this document, we find that many of our technical concerns have been addressed. However, as discussed, we still have concems on three major issues: (1) the need to characterize uncertainties in the risk

- coefficients for cancer mortality and morbidity for lifetime exposure to radionuclides in the environment; (2) the need to venfy and validato the assumptions used in calculating these risk coefficients, as well as validation of the values for the risk coefficients; and (3) the need for this document to undergo a complete review by affected members of the U.S. public, EPA's Science Advisory Board and the intemational radiation standards setting organizations. In light of these issues, as well as future efforts to characterize the uncertainties in the biokinetic models in other publications, I urge that FGR 13 be issued for public review and comment at this time.

I understand that you will consider our request for issuance of this report for public review and comment, rather than as a final FGR, and that your decision will likely be made in mid-January 1998. I also understand that you willinform as of your decision a few days prior to proceeding with publication of this report. If you need any additionalinformation or clarification of the issues we discussed, please contact me. I look forward to hearing from you in January.
