gentlemen.

This is an affirmation session.

We have one item 4

on the agenda and I will ask the Secretary to lead us through 5

that item.

6 SECRETARY CHILK:

The one item, Mr. Chairman, is 7

SECY-86-131, entitled litigation on Shoreham Emergency 8

Planning Issues.

In this paper, the Commission is being requested to 10 address a number of pending issues in the Shoreham Emergency 11 Planning adjudication.

I 12 The Chairman, Commissioners Roberts, Bernthal and 13 Zach have approved an order which one, directs continued l

14 deferral of ALAB-832 remand; two, it directs immediate

(

15 initiation of the exercise hearing to consider evidence which 16 intervanors may wish to offer to show that there is a 17 fundamental flaw in; the LILCO emergency plan; three, it notes 18 that the Commission is now reviewing ALAB-818 and expects to 19 issue shortly a decision on the realism and immateriality 20 issues; fourth, the Commission order also denies the June 3, 21 1986 supplement to the motion of Suffolk County, State of New 22 York and the Town of South Hampton which requested that NRC 23 find that FEMA's review of the February 13 exercise violated 24 FEMA's procedural rules requiring a public hearing.

25 Commissioner Asselstine approves in part,

1 disapproves in part and has provided separate views.

Chairman 2

Palladino noted that he would have preferred that the 3

Commission address all of the issues presented in ALAB-818 at 4

this time rather than only realism and immateriality.
