Dear Mr. Gipson:

This refers to the telephone conversation between J. A. Grobe and you and members of your staff regarding arrangements for an enforcement conference between members of our respective organizations. This conference is scheduled for Tuesday, November 18,1997 at 9:30 a.m. at the NRC Region ill office at 801 Warrenville Road, Lisie IL 60532.

The purpose of this conference is to discuss the findings of the inspection conducted at your facility on August 4 - October 10,1997. The inspection identified an apparent violation of NRC requirements. This apparent violation, which is being considered for escalated enforcement in accordance with the NRC Enforcement Policy (NUREG-1600) Involved the apparent failure to obtain prior Commission approval, in accordance with 10 CFR 50.59, for a change to the facility regarding emergency equipment cooling water (EECW) operation. Under certain accident scenarios, use of the EECW system to supplement the reac','r building closed cooling water system could lead to a possibility of a malfunction of equipment that was not previously analyzed.

inspection report 50-341/97011 was issued on October 29,1997, and a copy provided to your staff by October 30,1997. Please be prepared to discuss in both your oral presentation and in a concise written handout (1) the apparent violation, its root causes and significance, and the corrective actions planned or taken to prevent recurrence; and (2) the areas of concern and your plans to improve implementation of your NRC-licensed program.
