NRC INVESTIGATION REPORT 3-97-003

Dear Mr. Cook:

This letter concerns an allegation of employment discrimination by the Illinois Power Company at the Clinten Power Station. The NRC Office of Investigations (01) conducted an investigation into the matter, and concluded that based on the information developed during the lovestigation, the allegation of employment discrimination could not be substantiated. After consulting with the Director, NRC Office of Enforcement, a Notice of Violation is not being issued, and this letter concludes the NRC's review of this matter. A copy of the Region til Office of Investigations report synopsis is ericlosed.

L SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission.

Office of Investigations (01), Region III (RIII), on January 13, 1997, to determine whether a contract employee of Illinois Power Company working for North American Energy Services at the Clinton Nuclear Power Station was discriminated against for raising safety concerns regarding the use of radiation detection equipment.

Based on the evidence developed during the investigation, 01:RIII could not substantiate the allegation that the contract employee was discriminated against for raising safety concerns.
