PROPOSED IMPOSITION OF civil PENALTY - $4,400 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $4,400 will be issued on or about December 19,1997, to The Stroh Brewery Company. The action is based on a disposal of a generally licensed gauge by transferring the gauge to a scrap recycler.
In accordance with the Enforcement Policy, a base civil penalty in the amount of $4,400 is considered for a Severity Level 11 violation. Because the violation was categorized as a Severity Level ll violation, the staff considered whether credit was warranted for both identification and Corrective Action in accordance with the civil penalty assessment process in Section VI.B.2 of the Enforcement policy. Credit was not given for Identification because the loss was discovered as a result of an event. Credit was given for Corrective Action.
Therefore, a civil penalty in the base amount of $4,400 !s being proposed.
it should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice December 19,1937 Telephone Notification of Licensee December 19,1997 The Commonwealth of Pennsylvania will be notified.
The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
