PROPOSED IMPOSITION OF civil PENALTY - $13,750 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $13,750 will be issued on or about January 5,1998 to Westinghouse Electric Corporation, Columbia, South Carolina. This action is based on i eight violations involving criticality safety controls conskiered in the aggregate to represent a Severity Level ill problem.  !

Decause the licensee had previous escalated enforcement in July 1997, the staff considered l whether credit was warranted for identification and corrective action. Credit was not warranted for identification because the violations were identified by the NRC through an inspection. Credit was warranted for the corrective actions, which were judged to be prompt  !

and comprehensive from the time that NRC put the Ibensee on notice concerning the l problem. Therefore, the base civil penalty of $13,750 is being proposed. j lt should be noted that the licensee has not been spacifically informed of the enfoicement action. The schedule for !ssuance and notification is:

Mailing of Notice: January 5,1998 i Telephone Notification of Licensee January 6,1998 The State of South Carolina ivill be notified.

The licensee has thirty days from the date of the Notice in which to respond. Fol.c Ning NRC evaluatic, of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
