ENFORCEMENT GUIDANCE MEMORANDUM -

COORDINATION OF DISPUTED ENFORCEMENT ACTIONS WITH Tile OFFICE OF ENFORCEMENT Section 4.2.5.b of the Enforcement Manual provides guidance on the coordination of non-escalated Notices of Violation (NOVs) that are dispeted by licensees and Section 5.6.6.!

provides guidance for disputed escalated NOVs. In the interest of agency wide consistency and improved oversight of the enforcement program (especially in the area of non-escalated actions), OE is to be informed of all disputed enforcement actions.

Therefore, startine today, copies of all disputed NOVs, along with be submitted to OE within 1 week of receipt of the licensee's response. OE will promptly inform the regional enforcement coordinator whether OE desires to concur on the regional response.

2 This issue was addressed in OE's report on the 2 year review of the Ei.forcement Policy (Section 11.1.2). In addition to modifying Sections 4.2.5.b and 5.6.6.b, OE intends.o modify the standard forms for NOVs without civil penalties (Forms 41, II, and 111) to provide that licensees disputing the enforcement actions should submit a copy of their responw to the Director, Office of Enforcement. These changes will be made in an upcoming change to the EnforceUFnt Manual.
