COMMISSIONER DIAZ's COMMENTS ON SECY.97 2$3 At present, I doapprove the staffs recommendation of Option 1 and choose Option 2.

I do beleve it is appropriate that the Commission maintain separate consideration of the Anencialissues relating to operational safety and thoes relateg to assurance of decommissioning funding it also appears that the Commission may nood to establish clearer requirements and standards in its regulebons for post 4consing financial quairficebon of power roedor Scensees that do not meet the NRC's dentdtion of ' electric utility.'

I conclude, however, that the Commission needs a more thorou0h analysis and evaluabon of the rami 6 cations of a proposed rulemaking before the Commission approves e rulemaking option in th' area. The staff scknowledges that the proposed rule would not serve as a s

substitute for the Commisskm's primary rollence on inspection and other regulatory programs to ensure safety at operation. The staff appoors to identrfy the principal benefit of the proposed rulemaking as the availability of additional data for adjusting reguletory oversight. Yet, approval of a rulemaking approach in this ares can lead to unforseen interpretations and effects (molyding dimensions of Anality) unless the Commisalon's action rests upon thorough ana@is, and full exploration of allimpidiens.

Thus, I propose that staff return to the Commission in six months with a more definitive set of analyses 'oefore the Commission proceeds. I would like to see more detailed identincation of the safety concems that the NRC would like to address, the liksty effects and timing of developments in dereoutation and reetructuring reisting to those matte operational safety, and identmes' ion of optkms for addressing such issuec with efficiency.
