Dear Mr. Webb:

The Department has received and reviewed the Maine Yankee Atomic Power Station l'ost Shutdown Decommissioning Activities Report (PSDAR) which was submitted to the NRC on August 27,1997.

We wish to lend our support and concurrence to the comments pmvided by our counterparts in the Maine Department ofIluman Services. We also do not wish to impede the speed nor increase the costs, of a safe and orderly decommissioning of Maine Yankee. Ilowever, we are con;emed that such an aggressive schedule could lead to work needing to be repeated by Maine Yankee and/or imponant issues bemg overhked.

With regards to th'e enviror. mental impacts, it would seem that a 1972 environmental impact stabment (EIS) would not address the impacts that occurred at this site over the past j' twenty-five years. This EIS's purpose was solely for construction and operation concerns. The generic 1988 decommissioning EIS is based on no actual Maine Var kee site-specific data. We 0 also have concems with Maine Yankee's statement, "the non radiological environmental impacts from the Maine Yankee decommissioning are temporary and not significant." The PSDAR is general in scope such that it could apply to any nuclear power plant in the country and there is no fA0:7I or_ minimal' site specific data available to support such a conclusion.. The facility and site have been hosts to a myriad of hazardous chemicals, asbestos, lead and other hazardous constituents during its lifetime and any mishandling, spill, leak or release of any of these before or during the decommissioning process can be the cause of significant environmental impacts.

We agree that the need for federal state cooperation in this process must be maintained.

While the NRC regulates hiaine Yankee's reactor, including the decommissioning of the reactor site, it b this Department's responsibility to protect its citizens and the hiaine environment from any hazards existing on site and which may affect future land uses.

We urge your continued scrutiny of the decommissioning of the hiaine Yankee plant, and encourage NRC's continued cooperation with all involved state agencies and our concerned citircus to ensure that hia5e Yankee undertakes its plant decommissioning process in a safe and methodical manner.
