Dear Mr. Terry:
This refers to the inspection conducted on September 22 25,1997, at the Comanche Peak
Steam Electric Station (CPSES), and to the subsequent predecisional enforcement conference
conducted in the NRC's Region IV office on October 31,1997. The inspection included a review
of the changes that TU Electric made to the CPSES Emergency Plan under the provisions of 10 CFR 50.54(o). Four apparent violations were identified during the inspection and were
discussed during the exit briefing conducted on September 25,1997. TU Electric provided an
"
immediate, short term response to the NRC's concems in a letter dated September 26,1997.
Baced on the information developed during the inspection and the information providud during
the conference, the NRC has determined that violations of NRC requirements occurred. None
of the issues identified as apparent violations were eliminated, but they were combined as two
violations. These violations are cited in the enclosed Notice of Violation (Notice) and the
circumstances surrounding them are described in detailin the subject inspection report. The

first violation, which had a potential to affect the implementation of the plan, involves four
.
instances of TU Electric's failure to meet 10 CFR 50 54(q) when it made changes to the CPSES
Emergency Plan without the NRC's approval that both decreased the effectiveness of the plan
and did not continue to meet the 10 CFR 50.47(b) planning standard. The seconc dotation
involves three instances of TU Electric's failure to meet the provisions of 10 CFR f4.54(q) when
'
it made changes to the CPSES Emergency Plan without the NRC's approval that did not
continue to meet the 10 CFR 50.47(b) planning standard or 10 CFR Part 50, Appendix E
requirements.
During the October 31 conference, TU Electric contended that, except for the fourth apparent
violation, the identified apparent violations did not represent violations of NRC requirements.
This view appeared to center around the level of detail in previously approved emergency plan
.
revisions and the emergency plans of other licensees, TU Electric noted that the revisions were
given extensive reviews by different onsite organizations and also received peer reviews. Our
review of the regulatory requirements and the revisions that TU Electric made indicate that the
violat!ons did occur. The regulatory significance of the violations is based on our determination

that the violations did not indicate a orogrammatic breakdown in the control of your emergency
plan changes, and that the violations involve failures to meet a planning standard not directly

related to assessment and notification. However, the violations did indicate a need for greater
ddigence in assuring that plan changes continue to meet regulatory requirements and are not
,
implemented prior to assuring the continued effecti'eness of the plan or prior to obtaining NRC
!
approval, if needed. Given the circumstances surrounding the violations and E,e significance of
'
the changes, the NRC has concluded that the violations should be classified at Severity LevollV
in accordance with the " General Statement of Policy and Procedure for NRC Enforcement
Actions"(Enforcement Policy) NUREG 1600.
