APPLICANTS' RESPONSE TO FILINGS OF WEST NEWBURY Under date of May 23, 1986, the Town of West Newbury, Massachusetts, filed two petitions.
Both petitions seek an order making West Newbury a participant in these proceedings when, as and if any Radiological Emergency Response Plan filed by the Commonwealth of Massachusetts is considered.
One petition seeks participation as an interested municipality under 10 CFR S 2.715(c).
The other seeks intervention under 10 CFR S 2.714.
There is no doubt that West Newbury is entitled to participation under 10 CFR S 2.715(c) and an order should enter to that effect.

Newbury would have the requisite interest to participate under 10 CFR $ 2.714.
However, a final decision on 10 CFR S 2.714 status must await a demonstration with respect to the " late filing" criteria for late petitioners under 10 CFR
$ 2.714(a)(1) and the submission of a contention by West Newbury and a ruling as to the admissibility thereof.
