Dear Rev. Dr. Shearer:

I am writing in response to your letter of September 30,1997, to the U.S. Nuclear Regulatory Commission in which you asked to be advised of changes to the classification system for low-level radioactive waste (LLW), and how these changes might affect the LLW compact system. NRC is not makinc, and does not plan to make, any changes to the LLW classification e

system which is defined in our regulations (See 10 CFR 61.55, " Waste classification") and referenced in the Low-Level Radioactive. Waste Policy Amendments Act of 1985. The classification criteria are based on risk to the health and safety of the public and have been used successfully by generators of LLW and disposal facility operators since 1983.

If you have any questions, please call me at '301) 415-7298.

s Sincerely.
