Mellor, Vice President Operations and Decommissioning Connecticut Yankee Atomic Power Company 362 Injun Hollow Road East Hampton, CT 06424 3099 SUBJECT: EXERCISE OF ENFORCEMEb1 DISCRETION (NRC INSPECTION NO. 50 213/97 12) Dear Mr. Davis: This letter refers to special reactive inspections conducted by Dr. Jason C. Jang of this office on August 1213, and October 6-9,1997, of activities authorized by NRC license No. DPR-61 at the Haddam Neck Station, East Haddam, Connecticut and the discussion of our findings held with Mr. R. Mellor and other members of your staff at the conclusion of the inspections. Our letter dated March 21,1997, transmitting the results of NRC Inspection Report No. 50 213/97 02describad an apparerst violation involving the calibration of effluent radiation monitoring system components (eel 50 213/97 02-01). The NRC has considered that a violation of regulatory roosirements occurred. Specifically, contrary to Technical Specification 6.8, as of February 7,1997, the licensee failed to establish and implement procedures sufficient to test the above RMS as evidenced by: (1) no documentation or poor documentation of the electronic calibration data, (2) no performance of in situ primary calibration, (3) no plateau curve to determine optimum operating high voltage, (4' incorrect performance of the secondary calibration, and (5) no determinations of conversio.i' actors and linearity for the intended monitoring ranges. Your response, Revised Commitments and Corrective Actions, dated August 7,1997, was reviewed during this inspection. Our inspection confirmed the adequacy of your corrective actions relative to this specific deficiency. Such programmatic deficiency would normally be subject to escalated enforcement action. Howeveh efter consultation with the Deputy Regional Administrator and with the Director, Office of Enforcement, the NRC has decided not to issue a Notice of Violation or propose a civil penalty for this case.
