Commissioner Dieus' Comments on SECY-97-279 i
I approve staffs recommendation to implement Option 3 immediately as a long term solution and to implement Option 2 if a license renewal application is received before the rulemaking activity is completed. The staff should immediately notify the Commission if their ongoing supplemental analysis no longer supports a reasonable technical and legal determination that transportation of HLW is a Category 1 issue and may be generically adopted in a license renewal application.
