SUBJECT: RESPONSE TO NOTICE OF VIOLATION (NRC INSPECTION

REPORT 50-382/97 16)

Dear Mr. Dugger:

Thank you for Mr. E. C. Ewing's letter dated November 24,1997, in response to our letter

and Notice of Violation 50 382/9716-01, dated October 17,1997.

We note that you do not agree with Example 1 of Violation 50 382/9716 01. Your staff

concluded that for Example 1 of the cited violation, the operability assessment was

processed in accordance with the administrative guidance provided in Procedure W2.501,

" Corrective Action," and as.such, is not representative of the cited 10 CFR Part 50,

Appendix B, Criterion V violation.

After receipt of your letter, the inspector performed an additional review of work

documentation to determine the exact timing of the events that led to the conclucion that a

violation of 10 CFR Part 50, Appendix B, Criterion V, had occurred. The additional review

identified that the actual sequence of events was different from the inspector's original

understanding. From this additional information, we have concluded that NRC Inspection

Report 50 382/97-16 was inaccurate. As a result, we withdraw Example 1 of

Violation 50 382/9716-01.

However, our concern that engineering personnel did not promptly bring nonconforming

equipment to the attention of the operations staff for an operability evaluation remains

valid. Your staff identified that the electrical overload for Valve EFW 2208, emergency

feedwater isolation, did not meet test acceptance criteria on April 13,1997, and did not

initiate a condition report to provide operations the opportunity to perform an operability

determination until April 24,1997. Once a degraded or nonconforming condition is

identified,'an operability determination should be made as soon as possible, even though

complete information is not available.
