Dear Mr. Shepherd:
As was the subject of our recent telephone conversation, General Atomics (GA) is a party to settlement agreements with the U.S. Nuclear Regulatory Commission (NRC) related to the financial assurances for decommissioninD GA's facilities on its San Diego, California site and the Sequoyah Fuels Corporation (SFC) facilities in Gore, Oklahoma. These agreements define how the financial assurance provisions of Title 10 CFR Parts 40,50 and 70 will be met. They include comm!tments by GA to deposit funds in collateral accounts and trust funds. This, in tum, results in financial institutions providing laformation to the NRC regarding the subject funds deposited by GA.
The purpose of this letter is to request, as set forth in the attached affidavit of James R.
Edwards, Esq., that the above described financial information submitted to the NRC by various financial institutions be treated as proprietary information under the provisions of 10 CFR 2.790.
GA is a privately held corporation and the subject financial information is considered sensitive.

AFFIDAVIT OF JAMES R. EDWARDS 1, James R. Edwards, Vice President, General Counsel and Secretary of General Atomics, do hereby affirm and state:

I am an officer of General Atomics and I am authorized to execute this atiidavit on behalf of General Atomics.

This affidavit is submitted under the provisions of 10 CFR 2.790 in order to withhold financial information of General Atomics as described in GA's letter number 696/38/67-2855, dated January 14,1998, from public disclosure or publication.

The subject information constitutes confidential financial information of a privately held corporation which is held in confidence by the owner and is customarily held in such confidence, and is not available in public sources. Public disclosure would create substantial harm to the owner by providing details of financial information to its competitors and other parties whose interest may be adverse to the owner.
