Dear Mr. Toolle:

< By letter dated August 27,1997, the U.S. Nuclear Regulatory Commission (NRC) received your

, request for temporary exemption to the reporting provisions of 10 CFR 95.57(b) for the Paducah Gaseous DiNusion Plant.

Specifically,- you have requested that USEC be allowed to combine the discoveries made during your " class fied matter material review," as described in the letter mentioned above, and report L them to the NRC on a weekly basis rather than immediately as required by 10 CFR Part.

It was also stated in your letter that USEC will strictly meet all other reporting requirements not related to the ' classified matter material review."

f Since USEC will not be emitting any report, only delaying the reporting frequency, and because ,

of the potential number of reports that may be generated by the review e# ort, the NRC staff has

, determined that the.~e is merit to granting a temporary exemption. The staff also believes that the temporary delay in reporting will not pose an undue risk to the common defense and security for those discoveries made inside the fence line. However, any discoveries made outside the fence line must still be reported to the NRC within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />.

Based on USEC's September 23,1997, supplemental response to inspection Report 70-7001/97002-31 Notice of Violation, the NRC agrees to grant a temporary exemption until

. June 30,1998. USEC should make every effort to complete the review in the time frame -

l covered by the exemption.

USEC is hereby granted an exemption from the imraediate reporting requirements contained in g-

-_10 CFR 95.57(b) for those discoveries made within the Paduce.h Gaseous Diffusiona Plan line! USEC shall instead provide written reports on a weekly basis to the NRC of those 10 CFR J5.57(b) reportable events that occur within the fence line as a result of the " classified matter
