SUBJECn NRC INSPECTION REPORT 50-213/97-08

Dear Mr. Feigenbaum:

This refers to the safety inspection conducted by Mr. R. L. Nimitz, and others of this office

during the period July 3,1997, and August 11 - September 19,1997, at the Connecticut

Yankee Atomic Power Station, Haddam, Connecticut. The enclosed report presents the

findings of this inspection. The inspection findings were discusst,d by Mr. Nimitz with Mr.

Mellor of your staff and others on August 15,1997, and September 12,1997, and with

you on September 19,1997. This letter also refers to your letter dated September 16,

1997,in response to our letter and Notice of Violation dated August 12,1997.

Areas reviewed during the inspection were important to safety and aro discussed in the

enclosed NRC Inspection report. Areas reviewed during the inspection included the applied

radiological controls program, including external and internal exposure controls, the

contamination control program, training of personnel relative to 49 CFR 172 Subpart H, the

,

licensee's plans and activities assalated with radiological characterization of the site for

decommissioning planning purposes, and licensee action on commitments to the NRC

relative to NRC Confirmatory Action Letter (CAL) th. 1-97-082, dated March 4,1997.

The inspection included review of licensee provided documents at the NRC Region I office.

The inspection identified that efforts were on-going to perform initial scoping reviews of

the site for purposes of planning for cite characterization, remsdiation, and

decommissioning. Based on review of radiological survey data obtained by the end of the

inspection period, independent sampling and analysis of environmental samples, review of

radiological history files, and performance of independent radiological surveys, no apparent

significant residual radioactive contamination, that would pose and immediate health and

safety concern to the public or workers, was identified. However, a number of unresolved

, items were identified associated with previous unplanned releases of contamination to the

environment. These items are discussed in the enclosed inspection report and will be the

subject of further NRC review.

We have reviewed your September 16,1997, letter in response to our August 12,1997,

letter and Notice of Violation. The review was conducted in accordance with NRC

procedure 92904, " Plant Support." We have no questions on this letter at this time and

concur with your assessment of the root cause. The actions you have taken appear to be

acceptable and their effectiveness will be further reviewed in a future inspection.

The inspection identified two violations which are described in the enclosed Notice of

Violation. The first violation involved three examples of failure to follow rad lation

protection procedures and was identified by '.he NRC. The second violation involved failure

to perform adequate radiological surveys of material deposited in the landfill and was

identified by your staff.

You are required to respond to this letter and should follow the instructions specified in the

. enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements,

in accordame with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this lette ,

its enclosures, and your response will be placed in the NRC Public Document Room (PDR).

To the extent possibit, your response should not include any personal privacy, proprietary,

or safeguards information so that it can be placed in the PDR without redaction.
