Comments on SECY-97-186 I approve issuance of the proposed rule for the changes to the financial protection requirements at permanently shut down nuclear reactors. However, I am concerned that the staff has not addressed the impact of a reduced number of operating reactors that are required to maintain secondary financial protection and whether a decline in the number of operating reactors would require reconsideration on NRC's requirement to assure adequate financial protection and indemnity to meet the Price-Anderson statutory provisions. The staff should review this issue and provide the Commission with the results of the review and any recommendations, promptly.
