SUMMARY

OF MEETING WITH REPRESENTATIVES OF GREAT BAY POWER CORPORATION On December 16,1997, pursuant to notice, the NRC staff met with representatives of Great Bay Power Corporation (Great Bay) at NRC headquarters in Rockville, Maryand, to discuss -

decommissioning funding assurance. A list of meeting attendees is provided as the Attachment.

Great Bay owns 12.13240% of Seabrook Station. On July 23,1997, the NRC staff issued a temporary exemption to Great Bay from the requirements of 10 CFR 50.75 (e) (2) for assurance of decommissioning funding. The temporary exemption expires 1 year from its date of issuance or 90 days following the date of any revisions to 10 CFR 50.2 and 10 CFR 50.75, whichever

to continue efforts with due diligence to obtain a suitable decommissioning funding assurance arrangement that will meet the requirements of 10 CFR 50.75 (e) (2) and is to provide a written l

efforts underway and the progress made to obtain a suitable decommissioning funding assurance arrangemert.

L At the December 16,1997, meeting Great Bay described the efforts it has taken to obtain L

decommissioning funding assurance. To date no acceptable means of providing a surety l

method or insurance to meet the requirements of 10 CFR 50.75 (e) (2) have been found. Great Bay is currently exploring other options of providing funding assurance, One of the options proposed by Great Bay at the meeting was accelerated decommissioning funding. The Seabrook Station operating license will expire in 2026. Great Bay proposed accelerating its payme.1ts into the decommissioning fund such that its decommissioning obligations would be l~

met by 2015. Great Bay believes this would provide reasonable assurance that their portion of the decommissioning funds would be available prior to any foreseeable premature shutdown of

. the facility. With respect to the proposed rulemaking on decommissioning funding, Great Bay indicated that it was proceeding with a resolution to its current situation under the assumption

' that new regulations would not be issued prior to the expiration date of the temporary foj exemption.

In response to Great Bay, the NRC staff indicated that accelerated decommissioning funding does not appear to meet the intent of 10 CFR 50.75 (e) for 'other guarantee method" and that such a proposal would most likely be treated as an exemption to the current regulations.
